Since 2010, it is estimated that rideshare services like Uber and Lyft have facilitated over 11 billion trips worldwide. These services have totally shifted the way many people commute to work, run errands, or travel home after a night out. Requesting a ride via platforms like Uber and Lyft is fairly easy and makes transportation accessible for many people who otherwise might have struggled to safely get where they need to go.

As popular as these services are, however, their continued expansion raises important questions about public safety. When rideshare vehicles are involved in traffic accidents, trying to figure out who is responsible and how a claim should proceed can pose several logistical challenges. Most riders have never been put in this particular position before and may have no idea how to proceed in terms of recovering compensation for accident-related losses.

If you were injured in an Uber or Lyft accident in or around Omaha, the team at Inserra Kelley Cooper Sewell is here to help you land on the right next step in your fight for compensation. We can help you figure out who was most likely at fault for your car accident and advise you of any options you may have available to help you access the funds you need to address your medical and other expenses.

Because rideshare drivers often carry corporate insurance policies, it’s particularly important for individuals injured in these accidents to understand the options available to them. Contact us today to learn more about what makes these accidents different, and let’s work together to help you advocate for yourself under Nebraska law.

How common are rideshare accidents?

Specific data about the frequency of rideshare accidents can be hard to come by, particularly because these services are constantly expanding their offerings and service areas. Uber and Lyft both periodically publish their own safety reports to provide customers with some transparency.

In Lyft’s most recent report, the company noted that there were 50 motor vehicle fatalities associated with its services in the U.S. in 2022. Between 2021 and 2022, Uber reported 153 fatalities related to their U.S. platform. These fatal accidents are relatively uncommon, but even one tragic loss can have an impact that reverberates through an entire community.

While broader rideshare crash data is not widely available, some research suggests that the risk of injury crashes tends to increase as the number of rideshare trips goes up. As services like Uber and Lyft continue to gain popularity, it’s possible that we will see an increase in rideshare-related accidents. This is why it’s so important for consumers to understand their rights in the event that they are injured in a crash involving a rideshare vehicle.

What causes rideshare accidents?

Rideshare accidents can be traced back to a litany of causes, as can most other kinds of motor vehicle accidents. Some crashes are unavoidable due to weather conditions or other factors. Others, however, may be linked to preventable causes like:

  • Speeding
  • Driving under the influence
  • Texting or interacting with a rideshare app while driving
  • Tailgating
  • Improper lane changes
  • Failure to yield
  • Failure to stop at red lights or stop signs
  • Driving while tired
  • Picking up or dropping off riders in unsafe locations (like bike lanes or in the middle of traffic)
  • Improper vehicle maintenance
  • Negligent hiring practices

Sometimes, it may be the rideshare driver’s actions that cause a crash. Other times, another involved party may be deemed liable due to their negligence or recklessness. When handling these cases, we want to establish whether one involved party owed the other a legal duty of care and directly caused them harm by violating that duty.

For example, if your Uber driver rear-ends another vehicle while accepting another ride on their Uber app, they may be considered liable for any injuries you suffer because of their distraction. If, on the other hand, a rideshare driver is struck by another vehicle whose driver failed to properly yield at an intersection, the other driver may be considered liable for the crash.

What makes Uber and Lyft accident claims different?

Some aspects of rideshare accident cases are handled the same way we would handle any other car accident claim. If a driver other than your rideshare driver is found to be at fault for the crash that injured you, you may be able to recover compensation by way of their third-party liability coverage. It’s when a rideshare driver causes a crash that things can get a little complicated.

Rideshare drivers are contracted by companies like Uber and Lyft to provide transportation services. As such, transportation network company insurance must be maintained while these drivers are using the rideshare platform. Whether this insurance applies, however, depends on the driver’s status at the time of their accident.

In Nebraska, rideshare insurance usually works like this:

  • If a driver is logged out/off the clock at the time of an accident: The driver will need to rely on their private auto insurance for any applicable coverage.
  • If a driver is logged in and waiting for a new ride request: Their rideshare insurance must provide coverage of at least $25,000 for bodily injury or death to one person, $50,000 for bodily injury or death to two or more people, and $25,000 for property damage. The policy must also include uninsured motorist coverage as per Nebraska law.
  • If a driver is en route to or completing a ride: There must be at least $1 million of coverage available for death, personal injury, and property damage, and the policy must also include uninsured/underinsured motorist coverage of at least $25,000 per person and $50,000 per accident for bodily injury.

If you’re hit by a rideshare vehicle, you’ll need to know whether they were logged in at the time of the crash in order to proceed with your insurance claim. If they were driving on their own time, you’ll likely need to file a claim against their personal auto insurance policy, but if they were on the clock and caused the crash, the applicable rideshare liability coverage will likely serve as the first source of compensation.

Who can be held responsible for a rideshare accident?

If another driver’s negligence caused the accident that injured you, they could face claims of liability. If your rideshare driver caused the crash, however, they may be responsible for the harm you suffered. The rideshare company may also bear some responsibility, though that is less common. For example, if a company ignored a safety risk it knew about (or should have known about), you may be able to take action against them if that safety issue causes you harm.

These cases require careful investigation. At Inserra Kelley Cooper Sewell, we use the evidence and information available to us to identify all potential sources of liability for our clients. Sometimes, multiple parties will share responsibility for a crash, and pursuing claims against all at-fault parties can help injured parties access the full amount of compensation available to them under the law.

Every case is different, and the facts matter. That’s why it’s so important to partner with a rideshare accident lawyer who knows how these cases work and can help you identify the most appropriate advocacy strategy.
